Prepare one or more original video(s) of no more than five (5) minutes in length, displaying your “skid crib”. If your video contains audio, it must be in English. Please email your video embed code to: tmc@cloudveil.com along with your name, home address, and email address. Use the word Cribs in the Subject field. Your video must be entirely original; it must not infringe the property rights of any third party. Please do not edit your video to music unless you are the composer of all music used in the video or have the appropriate rights to use said music. This is the only method of entry. Cloudveil is not responsible for any lost, late, delayed, illegible, incomplete, mutilated, or misdirected entries. Cloudveil is not responsible for incorrect or inaccurate entry information caused by any technical or human error which may occur in the processing of the entries in this contest.
ELIGIBILITY
This contest is only open to legal residents of the contiguous United States. It is subject to all federal, state, and local laws and regulations. Employees of Cloudveil and its respective subsidiaries, retailers, distributors, affiliates and their agents, advertising, promotion and production agencies and their immediate family members (parents, children, siblings and spouses of children or siblings) and household members are not eligible. Contestants under the age of 18 must receive permission from a parent or guardian to enter.
By attempting to submit an entry, you release Cloudveil and its subsidiaries, and their respective officers, directors, employees, representatives, retailers, distributors, affiliates and their agents, advertising, promotion and production agencies from all losses and any and all liability for any loss, harm, damages, costs or expenses, rights, claims, and actions of any kind in connection with the contest, including without limitation, property damage, criminal prosecution, personal injury and/or death, arising out of your participation in this contest.
Failure to comply with all rules and regulations associated with the “Skid Cribs” contest could result in disqualification from the “Skid Cribs” contest.
ALL SUBMISSIONS
Any videos submitted during this contest are considered public domain. Cloudveil reserves the right to, in its sole discretion, cancel, modify or suspend this contest. Potentially offensive entries to the “Skid Cribs” will not be considered. Responses must be your own original images, not anyone else’s copyrighted and/or trademarked images. You hereby give Cloudveil the absolute right to use your response for any lawful purpose whatsoever in any and all forms of media. You hereby waive any right that you may have to inspect or approve the finished product(s), if any, that use your entry and any compensation resulting from the entry you submit.
By submitting an entry to this contest you represent and warrant that: (i) you own, or have the necessary licenses, rights, consents, and permissions to use and authorize the use, of all patent, trademark, trade secret, copyright or other proprietary rights in and to any the Content in the manner and (ii) you have the written consent, release, and /or permission of each and every identifiable individual person in the video to use the name or likeness of each and every such identifiable individual person.
The video is not (a) unlawful, obscene, defamatory, libelous, threatening, fraudulent, abusive, pornographic, harassing or encourages conduct that would be considered a criminal offense, or does or could give rise to civil liability or violate any law, rule or regulation, or is otherwise objectionable, (b) non-public information about any company that the person submitting is not authorized to disclose, or (c) an advertisement, solicitation, chain letter, pyramid scheme, investment opportunity or other unsolicited commercial communication.
All entries are subject to verification. Any entry that is tampered with, counterfeited, illegible, mutilated, reproduced, contains printing or other errors, obtained where prohibited or not obtained legitimately, is null and void. In the event that production, seeding, printing or other errors cause more than the stated number of prizes of any category to be claimed, Cloudveil reserves the right to suspend delivery of prizes, without prior notice.
SUBMISSION REVIEW
All entries must be received by 11:59 PM EDT on March 1, 2009. Review of entries will begin on or about January 14, 2009. All decisions relating to this contest are final.
All submissions will be reviewed by a panel of judges based on the following criteria: creativity/uniqueness of snow feature; quality of execution, and creativity/uniqueness of video. The final winner will be chosen based on the results of a public poll.
Winner will be notified by email or Federal Express on or about March 15, 2009. If a Prize Notification Letter or a Prize is returned as undeliverable, the Prize will be forfeited and awarded to an alternate winner in a random drawing from among all remaining eligible entries.
PRIZE AND ITS APPROXIMATE RETAIL VALUE ("ARV")
- There is one (1) prize package, consisting of one (1) Cloudveil Hoback, RPK, or Down Patrol Jacket, one (1) Cloudveil Hoback or RPK Pant, one (1) Cloudveil Run Don’t Walk fleece pullover, one (1) pair of Dynastar Legend Pro skis, one (1) pair of Look (Dynastar) Bindings, and one (1) one year subscription to Powder magazine. Approximate retail value of the prize package is USD Two Thousand Four Hundred and 00/100 Dollars ($2,400.00). Winner will have the opportunity to choose appropriate size of items.
Winner will be solely responsible for all federal, state and local taxes, license, fees or other costs. Cloudveil will ship prize to winner via UPS at Cloudveil’s expense. Cloudveil is not responsible for delays in delivery of any prize. Winner shall bear all risk of loss to prize after it has been received. Cloudveil is under no obligation to provide winner with any other substitute prize. In the event a winner is or becomes ineligible, the prize may be forfeited and awarded to an alternate winner in a random drawing from among all remaining eligible entries.
Winner of the Skid Crib Contest will be issued W-9 tax forms for the value of the prize.
Prize is non-transferable; no substitutions, exchanges, or product redemptions. Winner will be required to execute and return an Affidavit of Eligibility and Liability Release within fourteen (14) days of notification or prize will be forfeited and an alternate winner selected.
By participating in this contest, entrants agree to abide by and be bound by these Official Rules. Participants agree that this contest is exclusively governed by the laws of the State of Wyoming. Any claims arising out of the contest shall be governed by Wyoming law and may be brought only in a federal or state court in Wyoming. If any provisions of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
By accepting a prize, winner grants to Cloudveil the right to use his/her name, likeness, hometown and biographical information, for any lawful purpose, without further permission or compensation, except where prohibited by law.
